Viaero Web to Text Terms of Use

This document (Terms of Use) governs the usage of all elements of the text.viaero.com web application (the service) and/or any of its associated pseudonyms (txt.viaero.com, sms.viaero.com, etc.). Use of any portion of the Viaero Wireless Web to Text service constitutes a legally binding agreement to abide by the terms outlined in this document.

Violations of the terms of this agreement constitute grounds for the deletion or suspension of your account, the assessment of additional fees, or other corrective measures as deemed appropriate by Viaero Wireless, and in compliance with United States law.

This service is provided AS IS, with no guarantees, expressed or implied, and no warranties as to the fitness or merchantability of this service for any specific purpose. No guarantees are made as to service availability or stability. The service may change at any time with, or without, notice, as deemed necessary by Viaero Wireless.

Certain portions of this software may be licensed under the GNU General Public License (GPL), the MIT License, or certain versions of Creative Commons licenses.

Who May Use This System

Only current Viaero Wireless subscribers with accounts in good standing may use this system. Accounts must be validated by sending a text message (unbilled) to the phone assigned to the account. A separate account, different from that of the online billing portal, must be created to use this system.

Acceptable Use

This service may be used only to send Text messages to United States cellular subscribers, as long as those messages do not contain any of the following:

Unsolicited advertising
Hateful, harmful, threatening or demeaning contents
Exploitation or injection code
Viruses, worms or Trojans
Identity misrepresentations

Additionally:

Text messages cannot be received through this service.
Users may not use this service to send messages to multiple users at the same time.
Users may not use another person's phone number for their own account.
Users may not attempt to "hack" or otherwise compromise the account integrity of another user, the integrity of the system itself, or any element of the Viaero Wireless network.
The system may not be used for international text messaging.

All users of this system absolutely must:

Agree to these terms to use the system
Register their own account using their cell phone, a valid e-mail address, a first name, and their home ZIP code
Supply a valid phone number, e-mail address, name and ZIP code during account registration
Agree to pay for the use of Text messages sent through this service per their current service agreement

Viaero Wireless may, at its discretion:

Terminate a user's account at any time, with or without notice, for non-compliance with these terms
Terminate, move, or otherwise change the service in any way, at any time
Send un-billed messages to the user's phone to facilitate use of this service
Send information about special offers from Viaero Wireless to the user's registered e-mail address

In the event of serious breaches of this agreement, Viaero Wireless, at its sole discretion, may choose to seek any other legal remedy permitted under United States Law.

Charges and Fees

An active Viaero Wireless account is required for use of this service, and therefore, all Text messages sent are charged at the normal rate per your plan. Refer to your wireless service contract for details on your texting package and rates.

Messages sent to facilitate the use of this system (for example, account registration, password reset) are not billed to your account, and will originate from a customer service number, "611", or "1611".
