NE Colorado Cellular, Inc. d/b/a Viaero Wireless ("Viaero") is committed to providing all of its customers with the best online experience possible. Viaero does not block end users from accessing lawful websites, subject to reasonable network management, nor do we block applications that compete with our voice or video telephony services, subject to reasonable network management.

Acceptable Uses

Viaero permits the use of its broadband services for browsing the Internet (via Viaero phones or devices, including Viaero home routers), using email, downloading legally permissible content via the Internet, accessing and using corporate email and/or corporate business applications associated with its customers’ places of employment. Viaero prohibits any use that adversely or excessively interferes with another customer’s use of the Home Network, including but not limited to the following purposes: (a) server or remote application operation, Web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections, peer-to-peer ("P2P") file sharing, remote telemetry, or Supervisory Control and Data Acquisition; (b) substitutes or backups requiring full-time or dedicated data connections; (c) automated or manual routines which generate excessive amounts of network traffic; (d) sending or facilitating the sending of unsolicited bulk email; (e) software or other device operations that maintain continuous active Internet connections when a connection would otherwise be idle; or (f) redirecting television signals for remote viewing on a computer, as that term is defined in title 18, section 1030 (e)(1) of the United States Code ("Computer").

Service Description and Performance Characteristics

Viaero allows its customers to choose from several rate plans with different capacity levels. Information on these plans is available on our website at www.viaero.com. The typical speed range of broadband service experienced by most customers is 150 Kbps – 200 Kbps down and 50Kbps – 80 Kbps up. Viaero measures its network performance utilizing the following performance measurements and methodology. Using an FTP server located on our data routers, this details approximate latency and speeds that are within Viaero controls. We continue to monitor our Packet Data Service Node for network bottlenecks and latency. Viaero believes this approach provides the best approximation of actual speeds and latency for its service. Customers can verify speed using a variety of third-party websites, such as www.broadband.gov/qualitytest/about/ (as of November 20, 2011), to measure the provisional speeds of Viaero’s broadband service. Such third-party websites are not affiliated with Viaero and the company does make any guarantees as to the accuracy of test results obtained through those third-parties. Actual speeds may vary due to area, coverage, compression, among other factors.

Network Management Practices

Viaero does not block applications, impose usage limits, or engage in "throttling" to reduce the throughput to customers using a disproportionate amount of bandwidth. Instead, Viaero uses an "open pipe" approach and undertakes best efforts to ensure a high-quality online experience for all of its customers. As a result, at times of heavy usage, customers may experience delays in downloading or uploading files or a sluggish Web surfing experience. If significant congestion problems arise in the future, Viaero’s approach is to determine the source of the problem, and to increase the capacity of the affected portions of its network and/or of its Middle Mile routes where warranted. In the event of congestion, all traffic is classified as best effort.

Device Restrictions

All phones and devices connecting customers to carrier’s network must be provided by Viaero, due to network parameters in the device. More information about the specific devices approved for use on Viaero’s network can be found at its retail website at http://www.viaero.com.

Security Measures

Viaero does not take any measures to block data or applications from its customers, including potentially harmful malware/spyware/viruses. Customers are advised to utilize their own internet security software to mitigate risks.
